Fleeing DUI Stop Calvert County, MD | Criminal Defense Attorney
I’ve seen it happen more than once.
A driver gets pulled over in Calvert County, realizes they may be over the legal limit, panics, and drives off.
That split-second decision changes everything.
What might have been a misdemeanor DUI can quickly escalate into felony-level charges if you’re accused of fleeing and eluding law enforcement in Maryland.
If you’re reading this because it happened to you or someone you care about, don’t wait to get help.
Why Leaving the Scene Makes Things Worse
Maryland law takes DUI seriously. But once you flee a traffic stop or ignore an officer’s command to pull over, you’re now dealing with two separate charges:
- DUI or DWI
- Fleeing and Eluding Police (Transportation Article §21–904)
If you’re accused of both, you’re facing:
- Up to 3 years in jail
- $5,000 in fines
- 12 points on your license (automatic revocation)
- A potential felony record if someone is injured during the chase
Even if the attempt to flee only lasted a few blocks or involved hesitation at the shoulder, prosecutors treat it as a willful act, not a misunderstanding.
What Happens After You’re Caught?
In many cases, officers will:
- Immediately impound your vehicle
- Take you into custody on the spot
- File multiple charges: DUI/DWI, fleeing, resisting arrest, and sometimes reckless driving.
- Refer the case for enhanced prosecution.
Your court date will likely be in Prince Frederick District Court, and the case may even be moved to Circuit Court depending on the severity.
How I Defend These Cases
At Haskell & Dyer, I’ve defended clients charged with fleeing after a DUI across Calvert County—including along Route 4, Solomons Island Road, and MD 231.
Every case is different, but some of the strategies I use include:
- Arguing that there was no clear command to stop
- Showing confusion, not criminal intent
- Contesting dash cam or body cam footage
- Negotiating to separate the charges and reduce the DUI or fleeing to lesser offenses
- Fighting to protect your driving privileges and clean record
“A DUI is serious. But fleeing turns a bad night into a life-altering one. If you made a mistake, you still deserve a fair defense—and a shot at a better outcome.”
